1. About these Terms

These Terms of Service ("Terms") govern your use of namufootwear.com and purchases from NAMU Recovery, operating as NAMU Footwear ("NAMU," "we," "us," or "our"). Please read them before placing an order. By placing an order or otherwise indicating acceptance of these Terms, you agree to them.

Our Shipping Policy and Refund Policy provide additional purchase terms. Our Privacy Policy explains our information practices and your choices. Accepting these Terms or making a purchase does not by itself constitute consent to optional tracking, marketing messages, or a disclosure for which separate consent is required.

Nothing in these Terms limits rights or remedies that cannot lawfully be excluded, including applicable consumer, product, and privacy rights.

2. Eligibility and account information

To place an order, you must have legal capacity to enter into a purchase agreement. If you have not reached the age of majority where you live, a parent or legal guardian must place the order on your behalf.

Provide accurate contact, delivery, and payment information and update it when necessary. If you use an account, take reasonable steps to protect access credentials and notify us if you suspect unauthorized use. You are not responsible under these Terms for unauthorized activity to the extent applicable law provides otherwise.

3. Products and information

We sell footwear and related products. We aim to describe products, sizing, materials, colors, availability, and prices accurately. Screen settings and photography can affect the appearance of colors. Please review the product page and sizing information before ordering and contact us if you need help.

We may update product information, change future prices, or discontinue products. These changes do not automatically alter an existing purchase agreement. Product statements, express warranties, and rights required by law are not displaced by these Terms.

4. Orders, prices, and payment

Review your cart, total price, applicable taxes and shipping charges, delivery information, and any promotion conditions before submitting an order. The currency is the one displayed at checkout. By submitting payment information, you confirm that you are authorized to use the payment method.

An order confirmation acknowledges receipt of your order. We may decline or cancel an order for a reasonable reason, including suspected fraud, payment failure, unavailable inventory, an apparent pricing error, or violation of a disclosed purchase limit. We will notify you using the contact information provided and refund amounts paid for canceled items as required by law.

If a material price or product error affects an order, we will contact you about available options before proceeding on changed terms. We will not charge a higher price without your agreement. If we cannot fulfill the order and you do not agree to an alternative, we will cancel the affected portion and provide the refund required by law.

5. Shipping and delivery

Available destinations, shipping charges, processing estimates, and delivery information are provided at checkout and in our Shipping Policy. Delivery estimates can be affected by circumstances such as carrier delays, weather, and customs processing. If we cannot ship within the applicable promised period, we will provide any required notice, cancellation option, or refund.

Provide a complete delivery address and contact us promptly about an error, missing package, or damaged delivery. International duties, taxes, or import charges apply as disclosed at checkout or in the Shipping Policy. These provisions do not transfer responsibility or restrict a remedy in a way prohibited by applicable law.

6. Returns, exchanges, and refunds

Our Refund Policy explains return eligibility, timing, item condition, exclusions, and how to request a return or exchange. Review it before purchasing. Unless a lawful change is agreed with you, the policy applicable when you placed your order governs that purchase.

Return exclusions, final-sale terms, and ordinary return windows do not remove remedies you may have under applicable law for defective, misdescribed, or otherwise nonconforming goods. Contact info@namufootwear.com for assistance.

7. Promotions and communications

Promotions may have disclosed eligibility rules, expiration dates, exclusions, or limits. Review the offer's terms before participating. We may end or change future promotions, subject to existing commitments and applicable law.

A purchase does not automatically enroll you in every marketing channel. Email and text marketing are subject to the choices and any required consent provided for those channels. You may opt out using the instructions in a message or contact us. Necessary order and service communications may continue.

8. Comfort, recovery, and health information

General information about comfort, recovery, wellness, and footwear is provided to help you understand our products. It is not individualized medical advice and is not a substitute for advice from a qualified healthcare professional. Product experiences can vary. If you have an injury, medical condition, or persistent pain, seek appropriate professional advice.

This section does not disclaim product safety obligations, excuse misleading product claims, or limit rights concerning defective products or personal injury that cannot lawfully be excluded.

9. Shopify and third-party services

Shopify hosts our store and processes visit and purchase data. Enabled Enhanced Services may use interactions with other merchants and Shopify. Information is shared with Shopify and other providers, potentially abroad. See Shopify's Consumer Privacy Policy, its Privacy Portal, and our Privacy Policy.

Payment services, delivery tools, review features, and other third-party services may have their own terms where you use them. External links are provided for convenience. We do not control independent websites, but this does not exclude our responsibility for our own conduct or any responsibility imposed by law.

10. Reviews and public submissions

You retain ownership of reviews, photos, and other content you submit for public display. By submitting that content, you grant NAMU a nonexclusive, worldwide, royalty-free license to host, reproduce, display, and make reasonable formatting changes needed to publish it with the relevant product or review feature. This license does not grant permission to use private customer-support messages as public testimonials. Separate advertising or endorsement uses may require additional permission.

Submit content you have the right to share. Reviews should reflect your honest experience, and any incentive or other material connection should be disclosed where required. Do not include another person's private information, unlawful content, impersonation, or material that infringes others' rights.

We may moderate content for legitimate reasons such as spam, privacy, illegality, or irrelevance. We do not prohibit honest negative reviews or require you to waive rights protected by consumer review laws. Contact us about a privacy concern or a request to remove your submission.

11. Intellectual property and permitted use

Our website's original text, photographs, graphics, branding, and other protected material belong to NAMU or its licensors. You may browse the store and use it for lawful shopping and personal purposes. Other reproduction, distribution, or commercial use requires permission unless authorized by applicable law. These Terms do not restrict rights such as fair use or lawful consumer commentary.

You must not use the website to commit fraud, impersonate others, distribute malware, send spam, obtain unauthorized access, collect others' personal information unlawfully, or interfere with the store's security or operation.

12. Website availability and warranties

We take reasonable steps to maintain the website but cannot guarantee continuous availability or that all website content will always be free of errors. Maintenance, service interruptions, and changes may occur.

To the extent permitted by law, website functionality is provided on an "as available" basis. This statement does not exclude express product warranties or implied warranties, guarantees, or remedies that applicable law does not allow us to exclude.

13. Responsibility and limitations

To the extent permitted by applicable law, NAMU is not responsible for indirect or consequential losses that were not reasonably foreseeable when the relevant agreement was made. No exclusion or limitation applies to liability that cannot lawfully be excluded or limited.

In particular, these Terms do not exclude liability for fraud, willful misconduct, gross negligence, or death or personal injury caused by negligence where such exclusions are prohibited. They do not waive statutory privacy claims, mandatory product liability, or other nonwaivable consumer rights. Your right to seek remedies available under applicable law remains subject to that law.

14. Suspension and termination

We may reasonably restrict access where necessary to address fraud, unlawful conduct, a security threat, or a material violation of these Terms. Where appropriate, we will provide notice. You may stop using the website at any time.

Restricting website access does not automatically cancel a paid order, remove an accrued refund right, or eliminate legal obligations relating to an existing transaction. Provisions intended to apply after use ends, such as ownership and responsibility for existing obligations, continue to the extent lawful.

15. Governing law and disagreements

These Terms are governed by the laws of the State of California and applicable United States federal law, subject to mandatory protections that apply where you live. This choice of law does not deprive you of nonwaivable consumer protections or access to a court or regulator available under applicable law.

If you have a concern, you may contact us so we can try to resolve it. Contacting us first is not a condition that limits a legal right or filing deadline. These Terms do not require arbitration, waive class-action rights, or release claims arising before their effective date.

16. Changes and interpretation

We may revise these Terms for future use and purchases. We will update the effective date and provide additional notice or obtain acceptance when required by law. Changes do not retroactively alter an existing purchase agreement or an accrued right.

If a provision is unenforceable, the remaining provisions continue to apply to the extent lawful. A failure to enforce a provision on one occasion does not waive the right to enforce it later. If these Terms conflict with a mandatory legal requirement, the legal requirement controls. Specific, disclosed purchase or promotion terms control their subject matter only to the extent consistent with applicable law.
